Terms of Use, Disclaimer and Limitation of Liability

These Terms of Use ("Terms") govern your use of OfflineTranslator (the "app"), developed by BuildByte3D ("we", "us", "the developer"). By downloading, installing or using the app, you agree to these Terms. If you do not agree, do not use the app. This English version is the authoritative one; translations are provided for convenience and, in case of conflict, the English version prevails.

1. Nature of the Service

OfflineTranslator is a software tool intended to assist users with text translation, photo (OCR) translation and face-to-face voice translation. Translation, on-device OCR and speech recognition are performed locally on your device using Google ML Kit's on-device models; the app does not send the text, photos or audio you translate to a server operated by us, because we do not operate one. The app is a general-purpose translation aid, not a substitute for professional, certified or legal translation services.

2. No Guarantee of Accuracy

We do not guarantee the accuracy, completeness, reliability, contextual correctness or fitness for any particular purpose of any translation, transcription or text produced by the app. Machine translation and recognition technologies are inherently imperfect.

3. Machine Translation

Translations generated by the app may contain errors, omissions, ambiguities or inaccuracies. Results can vary depending on the language pair, context, register, dialect, and the quality of the source text, audio or image. A translation produced by the app should not be treated as equivalent to a translation produced by a qualified human translator.

4. OCR and Speech Recognition

The photo translation and face-to-face features rely on optical character recognition (OCR) and speech recognition, which may misread or mistranscribe input due to image quality, lighting, handwriting, unusual fonts, background noise, accents, pronunciation, overlapping speech, or other technical limitations. Errors introduced at this stage will carry through into the resulting translation.

5. Important Decisions

Do not rely solely on the app for legal, medical, financial, governmental, contractual, safety-critical or other consequential purposes, or in any situation where a translation error could cause economic, legal, medical, physical or other harm. For important documents or communications, independently verify the translation against the original text or through a qualified human translator or professional interpreter before acting on it.

6. User Responsibility

You are solely responsible for how you use the app and for how you use, share or rely on any output it produces. The app is a tool; it does not control, review, endorse or take responsibility for the content you input, translate, generate, transmit or otherwise use through it. You are responsible for ensuring that your use of the app, and of its results, complies with all laws and regulations applicable to you.

7. Unlawful or Harmful Use

We do not endorse or authorize using the app or its output for fraudulent communications, impersonation, scams, deception, illegal activity, misleading documents, unauthorized communications, or any other unlawful or harmful purpose. This is not a suggestion that the app is intended or designed for such uses; it exists to help people communicate and understand text across languages. If you use the app or its output for such purposes, you alone are responsible for that use and its consequences.

8. Software Availability and Performance

The app may contain bugs, errors or limitations, may be incompatible with certain devices or Android versions, and may not always be available or operate without interruption, including due to issues in the on-device models it relies on.

9. "As Is" and "As Available"

To the maximum extent permitted by applicable law, the app is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such warranties cannot legally be excluded or limited.

10. Limitation of Liability

To the maximum extent permitted by applicable law, and except where liability cannot legally be excluded or limited, the developer shall not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of data, revenue or opportunity, arising out of or related to your use of, or inability to use, the app, including damages resulting from translation, OCR or speech-recognition errors. Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited in your jurisdiction.

11. Mandatory Consumer Rights

Nothing in these Terms is intended to limit or exclude any statutory right or other right that cannot legally be waived or excluded under the consumer protection or other laws applicable to you. If any provision of these Terms conflicts with a right you are legally entitled to, that provision applies only to the extent permitted by law, and your legal rights remain unaffected.

12. Changes to These Terms

We may update these Terms from time to time. If we do, the "Last updated" date above will change accordingly, and material changes will also be reflected in the app's Play Store listing.
